The basics

This Policy describes how we collect, use and handle your Account Information (e.g. name, email address, password, date of birth, country of birth, etc.) and Digital Assets (your “Data”) when your use and access the software, services and websites (“Services”) provided by DiamondDox Ltd. (“DiamondDox”, “we”, “us” or “our”).

Changes to Privacy Policy (“Policy”)

We reserve the right to revise this Policy from time to time. We will date and post the most current version of this Policy on our website (the “Site”) and through our software (“Software”). Any changes will be effective upon posting the revised version of this Policy (or such later effective date as may be indicated at the top of the revised Policy). If, in our sole discretion, we deem a revision to this Policy to be material, we will notify you via the Service and/or by email to the email address associated with your account. Notice of other changes may be provided via our Site and Software. Therefore, we encourage you to check the date of this Policy whenever you visit the Site to see if it has been updated. Your continued access or use of any portion of the Service constitutes your acceptance of such changes. If you do not agree to any of the changes, we are not obligated to keep providing the Service, and you must terminate your account and stop using the Service.

Information We Collect

Information You Provide to Us

When you register to use our Services, communicate with our customer service team, send us an email, or post on our blog, you’re giving us information that we collect. That information may include your IP address, name, physical address, email address, phone number, date of birth, country of birth and other details like gender, occupation, and other demographic information.

Integral to our service we offer you the ability to archive, secure, organize, view and share your “Digital Assets” – documents, photographs, images, videos, audio recordings, files, personal information, contacts and other data – that when taken together constitute your legacy (“Your Legacy”). These Digital Assets are provided by you to us for the purpose of maintaining them on your behalf. For each Digital Asset, you provide us “Metadata” such as Document Title, its category, etc.

In addition, you provide us contact information – name, email address and phone number – for each person you choose to share a Digital Asset.

By giving us this information, you consent to your information being collected, used,

disclosed, and stored by us, only as described in our Terms of Use and Privacy Policies.

Information Collected When You Use Our Service

We may get information about how and when you use the Services. This information may include your IP address, mobile device ID, mobile vendor ID, time, date, browser type, browser version, operating system type/version, and actions taken by you within the application. As is true of most internet services we gather some information automatically either through log files or analytical tools. We use this information to understand and analyze trends, administer the Service, learn about usage patterns to improve our Service and to gather demographic information about our user base as a whole.

Cookies

When you register to use our Website, we store “cookies,” which are strings of code, on your computer. We use those cookies to collect information about when you visit our Website, when you use the Services, your browser type and version, your operating system, and other similar information. You may turn off cookies that have been placed on your computer by following the instructions on your browser, but if you block our cookies, it may be more difficult (and maybe even impossible) to use our Services.

Information from Other Sources

We may get more information about you, such as name, age, and participation in social media websites, by searching the internet or querying third parties (we refer to that information as Supplemental Member Information). We only collect data that’s publicly available or provided by a third party according to its terms of use.

Use and Disclosure of Your Personal Information

We may use and disclose your Personal Information ONLY as follows:

To promote use of our Services

For example, if you leave your Personal Information when you visit our Website and choose not to register, we may send you an email inviting you back. If we think you might benefit from using another Service we offer, we may send you an email describing the Service.

To notify you of owed fees, subscription renewal

This includes sending you emails, invoices, receipts, notice of subscription renewal and notices of delinquency. We use third parties for secure credit card transaction processing, and we send billing information to those third parties to process your orders and credit card payments. We DO NOT host your credit card information but may use a reputable third party service for this purpose.

To send you regular account summaries

We pro-actively assist you in archiving and organizing all your Digital Assets. For this purpose we send you routine notices regarding the state of those Digital Assets in your account, others you might consider adding and those persons you have chosen to share those Digital Assets. If someone has shared a Digital Asset with you we provide you notifications.

To help you secure your Personal Information

We routinely examine your account and the password you use to access the account in

order to assess its security level for the purpose of helping you protect your account from unauthorized use. We send you emails or notifications with the results from our assessment.

To send you System Alert Messages

For example, we may let you know about temporary or permanent changes to our Services, like planned outages, new features, new pricing, version updates, releases, abuse warnings and changes to our Policies.

To enforce compliance with our Terms of Use and applicable law

This may include developing tools and algorithms that help us prevent violations.

To provide customer support

To protect the rights and safety of our Users and third parties, as well as our own

To meet legal requirements

For example, complying with court orders and valid subpoenas.

To provide information to representatives and advisors

For example, attorneys and accountants, to help us comply with legal, accounting, or security requirements.

Public Information and Third Parties

Blogs, Forums

We have, or will have, public blogs and forums on our Website in order to assist our community of users. Any information you include in a comment on our blog may be read, collected and used by anyone.

Social Media Widgets

Our Service include social media features, like the Facebook Like button. These features may collect information about your IP address and which page you’re visiting on our site, and they may set a cookie to make sure the feature functions properly. Social media features and widgets are either hosted by a third party or hosted directly on our site. Your interactions with those features are governed by the privacy policies of the companies that provide them.

Links to Third-Party Sites

Our Services include links to other websites, whose privacy practices may be different from ours. If you submit Personal Information to any of those sites, your information is governed by their privacy policies. We encourage you to carefully read the privacy policy of any website you visit.

Notice of Breach of Security

No one is safe from hackers. If a security breach causes an unauthorized intrusion into our
system that materially affects you then we will notify you as soon as possible and later report the action we took in response.

Safeguarding Your Information

General

We take security seriously. When you access our Services communications are established between your client either through our web site or through an application. We host our Service on computer servers kept in a controlled environment with limited access. These servers are protected using one or more firewalls.

Data Communications

Data transferred between your computer (or mobile device) and our secure systems uses the latest 128 bit Secure Socket Layer (SSL) technology in order to protect you and your information.

Your Data

Specific personal information you provide our service such as your password, identification data, etc. is stored on our secure system using an industry standard 256 bit encryption algorithm that makes it prohibitively difficult to decrypt. We do NOT request nor store any of your credit card information. We use reliable third parties for payment services and they are responsible for requesting and managing your payment information.

Your Digital Assets

The Digital Assets you choose to archive as part of Your Legacy on our service are secured using an industry standard 256 bit encryption algorithm that makes it prohibitively to decrypt.

Notification

Hacking happens. If a security breach causes an unauthorized intrusion into our system that materially affects you then we will notify you as soon as possible and later report the action we took in response.

Accuracy of Data, Transparency and Choice

We do our best to keep your Personal Information accurate and up to date, to the extent that you provide us with the information we need to do that. If your Personal Information changes (like a new email address or mobile phone number), then you’re responsible for notifying us of those changes.

We only store data about you for as long as it’s reasonably required to fulfil the purposes that gave us the right to access it in the first place.

We give you access to any Personal Information about you that we hold within 30 days of any request for that information you make by emailing: legalservice@diamonddox.com. Unless it’s prohibited by law, we’ll remove any Personal Information about you from our servers at your request.
